By booking, purchasing, enrolling, or participating in any class, programme, or service provided by Three28.Pilates (“we”, “us”, “our”), you agree to be bound by these Terms & Conditions.
These Terms apply to all services offered by Three28.Pilates, including Adult Classes & Recovery (Reformer Pilates and Infrared Sauna) and Kids Ballet. Please read them carefully before proceeding.
2. Eligibility
Adult Classes & Recovery

Participants attending Reformer Pilates or Infrared Sauna sessions must be 18 years or older, unless otherwise approved in writing by Three28.Pilates.
Kids Ballet

Children may participate in Kids Ballet classes only with the consent of a parent or legal guardian

Parents or guardians are responsible for providing accurate enrolment, medical, and emergency contact details
-
Enrolment of a child constitutes acceptance of these Terms & Conditions on the child’s behalf
3. Health & Safety
All participants, or parents/guardians on behalf of children, must disclose any medical conditions, injuries, or concerns that may affect safe participation.
Adult Classes & Recovery
You confirm that you are medically fit to participate or have obtained appropriate professional clearance. Participation is at your own risk.
Kids Ballet
Parents or guardians acknowledge that Kids Ballet classes involve physical movement and accept the inherent risks associated with participation. Three28.Pilates takes all reasonable steps to provide a safe, age‑appropriate, and supportive environment.
4. Bookings & Attendance
All bookings and enrolments must be made through our approved booking and enrolment systems and are subject to availability.

Late arrivals may not be admitted for safety and class flow reasons

Missed classes are non‑refundable

Class places are non‑transferable unless approved in writing by Three28.Pilates
5. Enrolment, Memberships & Fees
Adult Classes & Recovery ( Reformer Pilates & Infrared Sauna )
Memberships
-
Memberships operate on a recurring payment basis via direct debit. By purchasing a membership, you authorise us to debit your nominated payment method at the agreed frequency.

Memberships are personal, non-transferable and non-refundable except as required by law.

Memberships will renew automatically unless cancelled in accordance with the required notice period.

A minimum notice period of 14 days in writing is required to cancel or suspend a membership.

Membership fees remain payable during any notice period.
Class Packs (Passes)

All class packs must be paid in full at the time of purchase.

Class packs are non-refundable, non-transferable, and subject to a stated expiry date.

Unused sessions will expire at the end of the validity period and cannot be extended, credited or refunded except where required by law.

Extensions may be considered in exceptional circumstances (e.g. medical reasons) at our discretion with supporting documentation.
Use of Sessions

Sessions included in memberships or class packs must be used within the applicable billing cycle or validity period and do not roll over unless explicitly stated.

Late cancellations or no-shows will result in forfeiture of the session and/or a fee as outlined in our cancellation policy.
Kids Ballet

Kids Ballet enrolment is generally term‑based
-
Fees must be paid by the nominated due date prior to the commencement of term
-
Annual enrolment fees, uniforms, costumes, or special event charges (where applicable) are additional and will be communicated in advance
-
Enrolment confirms your child’s place for the full term
-
Fees are non‑refundable once a term has commenced, except where required by Australian Consumer Law
Direct Debit, Failed Payments & Late Fees

If a direct debit payment is declined or fails, we reserve the right to:
- retry the payment; and/or
- suspend your access to bookings and services until payment is resolved; and/or
- charge a reasonable failed payment or administrative fee.
- a failed payment fee of $20 may apply per declined transaction.

If your account remains unpaid after the due date, we may charge a late payment fee or interest on overdue amounts, provided this is:
- clearly disclosed in these Terms;
- reasonable and reflective of administrative or processing costs; and
- applied in accordance with Australian Consumer Law.

Continued non-payment may result in cancellation of bookings or membership until all outstanding amounts are paid.
Membership Verification
To access certain memberships, offers, or partnered programmes, members may be required to provide valid proof of eligibility, including a current Cabramatta Rugby Club membership number and a photographic ID image.
Failure to provide accurate or current verification details may result in restricted access, suspension, or cancellation of the relevant membership or service.
6. Cancellations, Suspensions & Absences
Adult Classes & Recovery

Cancellations must be made within the cancellation window stated at the time of booking

Late cancellations or no‑shows will result in loss of the session or applicable fee
-
Memberships continue to bill during absences unless a suspension has been approved in writing
-
Suspensions may be granted for medical reasons at the discretion of Three28.Pilates, with supporting documentation
Kids Ballet
-
Absences do not qualify for refunds or credits
-
Make‑up classes are not guaranteed and are subject to availability
-
Withdrawal from Kids Ballet requires written notice prior to the commencement of a new term
7. Pricing & Payments

All prices are listed in Australian Dollars (AUD)

Prices may change at any time
-
Promotional offers, trials, or discounts cannot be combined unless otherwise stated
-
Failed or declined payments may incur additional fees and result in restricted booking access
8. Conduct & Behaviour
Three28.Pilates reserves the right to refuse entry or remove any participant whose behaviour is unsafe, disruptive, or disrespectful.
Kids Ballet

Children are expected to follow teacher instructions and studio guidelines
Ongoing disruptive or unsafe behaviour may result in removal from class
Parents or guardians will be notified if behavioural concerns arise
9. Photography & Media
Three28.Pilates may take photographs or video recordings for studio, promotional, or marketing purposes. Consent is obtained through enrolment forms. If you do not wish for your child to be included, please notify us in writing.
10. Liability
To the extent permitted by Australian Consumer Law:

Participation in all services is at your own risk

Three28.Pilates is not liable for injury, loss, or damage except where required by law

Parents or guardians accept responsibility on behalf of children enrolled in Kids Ballet
11. Refund Policy
Three28.Pilates does not offer refunds for:

Change of mind
-
Unused classes
-
Missed sessions
-
Studio closures due to circumstances beyond our control
Your rights under the Australian Consumer Law are not affected.
12. Changes to Services or Schedule
Three28.Pilates reserves the right to amend class times, instructors, services, pricing, or schedules as required. Reasonable notice will be provided where possible.
13. Privacy
Personal information is handled in accordance with our Privacy Policy, including additional protections for children’s information.
14. Acceptance of Terms
By booking, enrolling, or attending any service at Three28.Pilates, you confirm that you have read, understood, and agreed to these Terms & Conditions.
